Питання кейсу:


До UCBI звернувся клієнт з необхідністю подати в Іспанії декларацію за формою Modelo 100 для цілей декларування доходів, отриманих впродовж 2025 року.


Особливості кейсу:


Серед доходів клієнта за минулий рік – дохід від продажу квартири у Великій Британії, за який було нараховано та сплачено податок у розмірі 11 200 доларів США. А це – ризик подвійного оподаткування. Правильне відображення зазначених доходів та надійний супровід клієнта у взаємовідносинах з податковою Іспанії стало визначальним фактором.


Експерти UCBI  допомогли клієнту подати декларацію за формою Modelo 100, в якій  коректно відобразили суму податку, сплаченого у Великій Британії, як податок, сплачений за кордоном. Ця сума була заявлена у розділі щодо податків, сплачених в іншій державі, з метою застосування механізму уникнення подвійного оподаткування відповідно до положень Конвенції між Іспанією та Великою Британією про уникнення подвійного оподаткування.


Після подання декларації Modelo 100 податковий орган Іспанії надіслав запит, у якому повідомив про необхідність впродовж 10 робочих днів надати документи, що підтверджують сплату податків у Великій Британії.


Зокрема, необхідно було надати:

  • – декларацію, подану до податкових органів Великої Британії;
  • – документи, що підтверджують суму нарахованого та сплаченого податку;
  • – підтвердження фактичної сплати податку;
  • – переклад зазначених документів, щоб податковий орган Іспанії міг перевірити право на застосування механізму уникнення подвійного оподаткування.

Всі документи були оперативно опрацьовані та вчасно надіслані згідно з вимогою.


Результат:


Результатом взаємодії клієнта з UCBI стала надійна підтримка, супровід процесу декларування доходів клієнта та оперативне опрацювання запиту від податкової. Податкова служба Іспанії підтвердила: податок, заявлений у декларації Modelo 100 як податок, сплачений за кордоном, був задекларований та сплачений у Великій Британії.
