Інструкція SEM 2/2026: новий шлях легалізації для українців в Іспанії


22 червня 2026 року Іспанія опублікувала Інструкцію SEM 2/2026 — документ, який нарешті дає чітку юридичну дорогу для переходу з тимчасового захисту на стабільний статус.


До 4 березня 2027 року залишається менше 9 місяців. Діяти можна вже зараз.



Що змінилося


Раніше пункт 191.7 Регламенту про іноземців блокував зміну статусу для бенефіціарів тимчасового захисту. Тепер ця норма не застосовується, і можна перейти на:

  • residencia por cuenta ajena (найманий працівник)
  • residencia por cuenta propia (самозайнятий)

безпосередньо з тимчасового захисту, не виїжджаючи з країни.


Для cuenta ajena потрібен діючий трудовий договір, для cuenta propia – реєстрація як autónomo та підтвердження діяльності.


Arraigo – теж доступний


Весь час, проведений в Іспанії під тимчасовим захистом, повністю зараховується у два роки, необхідні для arraigo. Залежно від ситуації можна претендувати на:

  • arraigo social
  • arraigo laboral
  • arraigo socioformativo

Подати заявку можна, ще залишаючись власником тимчасового захисту.


Діти


Передбачені пільгові умови за статтями 159 і 160:

  • діти, народжені в Іспанії – без вимоги двох років проживання, в окремих випадках без підтвердження доходів і житла
  • діти, народжені за межами Іспанії – також мають право на спрощений порядок за тими самими статтями

Заявку на дитину можна подати навіть якщо батьки ще не змінили свій статус.


Студенти


Два шляхи:

  • Перший. Виконуються умови статті 191 → перехід на residencia y trabajo
  • Другий. Ні → arraigo socioformativo за умови підтвердження навчальної діяльності


Повний перелік доступних дозволів.


З тимчасового захисту можна подавати на будь-який дозвіл, що оформляється з території Іспанії:

  • дозволи за Регламентом про іноземців
  • дозволи за Законом 14/2013 (підприємці, висококваліфіковані фахівці)
  • residencia de familiar de español для членів сім’ї громадянина Іспанії

Важливо про час проживання


Весь період під тимчасовим захистом зараховується у п’ять років, необхідних для residencia de larga duración, і додається до нового дозволу, якщо його буде отримано. Накопичений час не втрачається.


Процедурний момент


Під час розгляду нової заявки тимчасовий захист продовжує діяти, можна легально перебувати та працювати в Іспанії. Після отримання нового дозволу необхідно офіційно відмовитися від тимчасового захисту, а підтвердження цієї відмови подається разом із заявою на TIE.
